The Cease and Desist letter - an apology?


You might remember my articles about that nasty letter I got from
Tim Herr, the USHPA lawyer, demanding that I pull off the Oz Report web site a
document that he claimed I ripped off the USHPA web site (I did not).  The

At the time I wrote:


I have received an email from one member of the USHPA Executive
Committee offering his personal apology for the letter that I received yesterday
from Tim Herr, the USHPA lawyer, demanding that I take off the Oz Report web
site a copy of the Competition Workgroup's proposal for changes to the USHPA
Competition Rulebook.  The EC member also stated that the letter was
embarrassing (which, of course, is a bit of an understatement), and that he
would seek a formal apology and retraction from the EC next week.  We'll see how
that goes.


Well, the EC member did get this item on the agenda for the EC
meeting, but the EC did not issue a formal apology and a formal retraction of
the letter from Tim Herr. (They would have looked really good if they had done
this, but, heh, their choice.)

But the EC member said that he would arrange for an informal meeting with me and
the EC. That meeting took place in the restaurant of the Embassy Suites hotel in
Austin, Texas Wednesday evening, prior to the USHPA BOD meeting. It lasted about
ten minutes at the most. I didn't apologize for putting up the document (two
copies of which I had received from BOD members) and they didn't formally
apologize for the letter or issue a retraction.

But everyone was cool about the whole thing, and I heard a few of them say that
it was probably not a really great idea to have Tim fire off that letter and
that it would have been much better to have Paul Montville call me up or write
an email to me first, to ask me to take down the document.

Lisa claimed responsibility for getting the ball rolling down toward me, as we
already knew, and everyone said that no one on the EC saw the letter before it
went out or even knew that Tim was going to send out such a letter. It looks
like the EC is not happy that they didn't get to see such a letter first, and
maybe there will be a little tighter leash on Paul Montville, when it comes to
this type of thing.

I heard some on the EC say that this didn't reflect well on the USHPA. (To say
the least.)
